Our client arrived in Australia in late 2018 as the holder of a visitor visa and has the condition 8503 on its grant. No further stay condition means you are not entitled to apply for a further visa application onshore. However, you are entitled to request waiver of condition 8503.
Our client is 80 years old widow who suffers from lower back pain which contributed to her having developed Meniere’s disease which resulted in our client to have restrictive mobility and inability to conduct activities of daily living. In or about March 2019 our client was diagnosed with anxiety and other physical disorders which made our client unfit for travel and the treating doctor suggested our client to undergo medical treatment and rehabilitation to improve her impairment in mobility and activities of daily living.
Condition 8503 restricts a visa holder’s ability to submit further visa applications onshore. Our client approached our agents and gave a detailed instruction on her matter. Our agents then analysed our client’s case and merits and sought to waive the condition.
Through the assistance of our agent, our client was able to have her condition 8503 waived from her visitor visa. It was argued on our client’s behalf that there are compelling and compassionate circumstances that have developed since the grant of the visa. It was further argued that the compelling circumstances that our client went through such as her illness and physical immobility were beyond her control that resulted in a major change in her life. It was also argued that our client’s family’s presence in Australia meant that she will receive family support.
This is not the first time our migration agents successfully waive conditions 8503. Our migration agents are experienced in Australian immigration laws and area able to assist you with all your migration matters to ensure smooth and successful outcomes.
